These Terms of Service ("Terms") govern your use of the MevoHost website and services. By creating an account or using any MevoHost service, you agree to be bound by these Terms.
1. Definitions
- "Services" means all hosting, domain registration, and related products offered by MevoHost.
- "Customer" or "you" means the individual or entity that has registered for a MevoHost account.
- "Content" means all data, files, and materials you store or transmit using our Services.
2. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised access.
You must be at least 18 years old to create an account. Accounts may only be created by individuals; if you are registering on behalf of a company, you represent that you have authority to bind that company to these Terms.
3. Acceptable Use
Your use of our Services is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. Violation of the Acceptable Use Policy may result in immediate suspension or termination of your account without refund.
4. Payment & Billing
Services are billed in advance on a monthly or annual basis. All prices are shown in USD unless otherwise stated. You authorise MevoHost to charge your payment method for all fees due.
Invoices are sent by email before each billing cycle. If a payment fails, we will retry up to three times over seven days before suspending your account. Suspended accounts are held for 14 days before deletion.
All prices are subject to applicable taxes. Customers in VAT-applicable regions will be charged VAT at the prevailing rate.
5. Refunds
Our refund terms are detailed in our Refund Policy. Domain registrations are non-refundable once the domain has been registered with the registry.
6. Service Level Agreement
We target 99.9% monthly uptime for all hosting services, calculated excluding scheduled maintenance. In the event of downtime below this threshold caused by MevoHost, we will provide service credits upon request. Credits are the sole remedy for downtime and do not entitle you to a cash refund.
7. Your Content
You retain all ownership of your Content. You grant MevoHost a limited licence to store, transmit, and process your Content solely as necessary to provide the Services. You are solely responsible for your Content and must ensure it complies with all applicable laws and these Terms.
We do not access, review, or use your Content except as necessary to provide the Services or as required by law.
8. Intellectual Property
All MevoHost branding, software, documentation, and website content is the property of MevoHost Ltd and protected by applicable intellectual property laws. You may not reproduce, modify, or distribute any part of our services or content without prior written consent.
9. Termination
You may cancel your account at any time from the control panel. Cancellation takes effect at the end of the current billing period unless you request immediate termination.
We may suspend or terminate your account immediately if you violate these Terms, fail to pay outstanding invoices, or engage in activity that we reasonably believe poses a risk to our infrastructure or other customers.
Upon termination, we will delete your data within 90 days. You are responsible for downloading your data before account closure.
10. Limitation of Liability
To the maximum extent permitted by law, MevoHost's total liability for any claim arising from these Terms or your use of the Services shall not exceed the total fees paid by you in the 12 months preceding the claim. MevoHost is not liable for indirect, incidental, special, or consequential damages including loss of profits or data.
11. Indemnification
You agree to indemnify and hold harmless MevoHost, its officers, employees, and agents from any claims, damages, or expenses arising from your Content, your use of the Services, or your violation of these Terms.
12. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Changes to Terms
We may update these Terms from time to time. We will notify you by email at least 30 days before material changes take effect. Your continued use of the Services after that date constitutes acceptance of the revised Terms.
